  1. Definitions
    "Client" refers to the individual or entity booking the chauffeur service.
    "Company" refers to Port Stephens Prestige and its employees, subcontractors, or affiliated drivers.
    "Service" refers to any transportation services provided by the Company.
    "Driver" refers to any person operating a vehicle on behalf of the Company.

  2. Booking and Payment
    Bookings are subject to availability and are not confirmed until written or electronic confirmation is provided by the Company. Full payment must be made at the time of booking or at least 24 hours prior to the scheduled service, unless otherwise agreed in writing. Accepted payment methods include credit or debit card. All quoted prices are in Australian Dollars (AUD) and include GST.

  3. Cancellations and Refunds
    Cancellations made more than 24 hours prior to the scheduled pick-up time will receive a full refund. Cancellations made within 24 hours may incur a fee of up to 100% of the total fare, depending on circumstances such as distance travelled and loss of business. Cancellations to or from Airports or cruise ship terminals, within 3 hours will incur a fee of 100% of the fare. No-shows or failure to notify will result in a full charge. If a fare is cancelled partway through a journey, the passenger may request to be returned to the original pick-up location, subject to an additional charge. The return journey will only proceed once the fare has been paid.

  4. Waiting Time and Delays
    A grace period of 10 minutes is allowed for standard bookings. Additional waiting time will be charged in 15-minute increments at the rate applicable to the original booking. The Company is not responsible for late arrivals or missed appointments, reservations, flights, or cruises due to waiting beyond the scheduled pickup time or delays caused by traffic, weather, accidents, force majeure events, or other unforeseen circumstances.

  5. Passenger Conduct
    The paying Client is responsible for the behavior of all passengers. Smoking, the use of illegal substances, possession of weapons, open alcohol containers, and any form of disruptive behavior are strictly prohibited. Disruptive behaviors include, but are not limited to, severe intoxication, impairment due to drugs, refusal to wear a seat belt, physical or verbal abuse directed toward the driver or the public. The Company reserves the right to terminate the journey without refund if misconduct or safety concerns arise. Failure to comply with the driver's request to exit the vehicle may result in involvement of law enforcement and legal action as deemed necessary.

  6. Liability
    The Company shall not be liable for any loss or damage to personal belongings, or for missed appointments, flights, cruises, or reservations due to delays, weather, or natural disasters. The Company's liability for any claim shall not exceed the amount paid for the service.

  7. Vehicle Damage
    The Client is responsible for any damage to the vehicle - both interior and exterior - caused by themselves or any party member. A minimum cleaning fee of $100 may apply for spills, vomiting, or any soiling of the interior. All damage and cleaning fees are applied at the discretion of the Company.

  8. Force Majeure
    The Company shall not be held liable for failure or delay in performing obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of God, war, strikes, pandemics, or government restrictions.

  9. Privacy
    All client information is treated in accordance with the Privacy Act 1988 (Cth). Information will not be shared with third parties unless required by law. Port Stephens Prestige does not sell or rent client data. Reasonable steps are taken to protect personal information from misuse, loss, or unauthorised access. If you believe your privacy rights have been breached, please contact us directly. If unresolved, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC).

  10. Amendments to Terms
    The Company reserves the right to amend these Terms and Conditions at any time. Updated terms will be published on our website. Continued use of the service constitutes acceptance of the revised terms.

  11. Governing Law
    These Terms and Conditions are governed by the laws of the State of New South Wales, Australia.

  12. Acknowledgement
    By booking and using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
